On My Way ("we", "our" or "OMW") is committed to protecting the privacy of all visitors to our mobile application (the "Application"). Please read the following privacy policy which explains how we use and protect your information (the “Terms”).

By visiting and/or using our Application, you acknowledge that you have read and understood this Privacy Policy and expressly consent to the collection, use, transfer, processing, and disclosure of your personal data as described herein. If you do not agree with these terms, please do not use the Application.

This privacy policy applies only to the Application, and does not extend to the websites of any other companies or organizations (including vendors) to which we link, and specifically addresses our obligations in respect of applicable laws in the United Arab Emirates ("UAE").

1. Information That We Collect From You

OMW may collect the following information from users of our Application: first name, last name, phone and contact numbers, car plate number, e-mail address, GPS location, payment details, and any other information that can identify you individually (collectively, "Personally Identifiable Information" or "PII"). We will collect such information as necessary for providing our services, improving user experience, maintaining security, and as permitted by applicable law. You acknowledge that failure to provide certain required information may result in our inability to provide some or all of our services.

In addition, OMW may collect information regarding your past orders, favourite vendors, service/vendor reviews and certain social networking preferences (e.g. pages you "Like" or "Recommend").

OMW also uses analytics software to track and analyse traffic on the Application in connection with OMW advertising and promotion of OMW services. OMW may publish these statistics or share them with third parties without including PII.

Non-Personally Identifiable Information (or "Non-PII") is aggregated information, demographic information and any other information that does not reveal your specific identity. We and our third party service providers may collect Non-PII from you, including your operating system (such as Apple iOS or Android OS) version and demographic data, for example your location, gender and date of birth and we may aggregate PII in a manner such that the end-product does not personally identify you or any other user of the Application. We and our third party service providers may also use cookies, pixel tags, web beacons, and other similar technologies to better serve you with more tailored information and facilitate your ongoing use of our Application. If you do not want information collected through the use of cookies, there is a simple procedure in most browsers that allows you to decline the use of cookies.

IP Addresses are the Internet Protocol addresses of the phones that you are using. Your IP Address is automatically assigned to the smartphone that you are using by your Internet Service Provider (ISP).

Use Of Your Information

Your information will enable us to: (1) provide you with access to the Application and requested services; (2) process payments and billing; (3) communicate regarding services; (4) administer, support, improve and develop our business; (5) conduct statistics and analytical research; (6) prevent fraud and enhance security; (7) develop new products and services; (8) conduct market research and business planning; and (9) comply with legal obligations. You acknowledge these uses are essential to our business operations and service delivery.

We use cookies to remember users on the Application and to enhance users' experience on the Application. OMW shares collected PII to third-party vendors and service providers with whom OMW works to provide application programming interfaces and other functions for the Application in connection with the OMW’s services. In addition, OMW shares users' order content, special order instructions, car plate number, and telephone number with vendors where users' orders are placed to the extent necessary to process those orders. OMW may also disclose PII to third parties such as attorneys, collection agencies, tribunals or law enforcement authorities pursuant to valid requests in connection with alleged violations of OMW terms of use and service or other alleged contract violations, infringement or similar harm to persons or property.

User generated content posted through the Application such as service/vendor reviews and certain social networking preferences (e.g. pages you "Like" or "Recommend") may be viewed by the general public. Accordingly, OMW cannot ensure the privacy of any PII included in such user generated content.

Because Non-PII does not personally identify you, we may use such information for any purpose. In addition, we reserve the right to share such Non PII, which does not personally identify you, with our affiliates and with other third parties, for any purpose.

We may provide you with options to express your preferences regarding data usage through various mechanisms within our services. However, certain data processing activities are essential to our service provision and cannot be opted out of while continuing to use our services. Any preference settings you select will be applied within a reasonable time period, subject to technical and operational constraints.

We may use your information to contact you for your views on our services and to notify you occasionally about important changes or developments to the Application or our services.

You agree that we may use your information to let you know about our other products and services that may be of interest to you including services that may be the subject of direct marketing and we may contact you to do so by post, telephone, mobile messaging (e.g. SMS, MMS etc.) as well as by e-mail. Where you have chosen at a device level to begin or continue receiving push notifications from us, we may send you push notifications relating to the services that you have requested from us and information about our services and offers. You can choose to stop receiving push notifications from us at any time by changing your preferences on your mobile device or by contacting us (see Contact).

2. Disclosure Of Your Information

The information you provide to us will be transferred to and stored on our servers.

We share some or all of your personal data with third parties when it is necessary to fulfill your requests, comply with legal obligations, protect our legitimate business interests, ensure the security and functionality of our services, or with your explicit consent.

Third parties process information such as credit card payments and provide support services related to payments for us. Third parties also help us analyse the information we collect so that we can administer, support, improve and develop our business and services to you.

In addition, we may need to provide personal information during the order process including name, phone number, email address, plate number, car and other similar information used to identify you and complete an order. Some of the personal information collected at our Application will be shared with our (“Vendor”) when processing your order. We have an agreement with all member Vendors, restricting disclosure or further processing of personal information provided to them by us. Your personal information will be used to notify you of your order status.

Your personal data will not be shared with any of our business partners or affiliates without your permission. It is treated as confidential, and will not be disclosed to outside parties, unless compelled by applicable legislation. We only send marketing emails and digital voice messages to those people who have specifically requested to receive this information.

Only with your explicit opt-in consent, which can be withdrawn at any time, we allow carefully selected third parties to contact you about relevant services. You will be provided with clear information about each third party before being asked for consent. You have the right to withdraw this consent at any time. They may only contact you by e-mail. If you change your mind about being contacted by these companies in the future, please let us know by using the contact details set out below and/or by amending your profile accordingly. We may also share your personal data with marketing companies who help us analyse the personal data we collect so that we can administer, support, improve and develop our business and services to you.

If our business enters into a joint venture with, purchases or is sold to or merged with another business entity, or undergoes any form of corporate restructuring, your information may be disclosed or transferred to the target company, our new business partners, owners, their advisors, or any relevant third parties involved in the transaction. We will notify you of any such transfer and ensure appropriate safeguards are in place to protect your data.

We may use the information that you provide to us if we are under a duty to disclose or share your information in order to comply with (and/or where we believe we are under a duty to comply with) any legal obligation, or in order to enforce our Terms of Use of the Application and the Terms of Service and any other agreement, or to protect the rights of OMW, Vendors or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and prevention.

Subject to obtaining your prior approval as outlined above, we may share, transfer, or store data we have received from you with our business partners, service providers, and data processors located in countries or jurisdictions other than the UAE, including countries that may not provide the same level of data protection as the UAE. Any such transfers will be subject to appropriate safeguards, such as standard contractual clauses or binding corporate rules, in accordance with applicable data protection laws. The laws governing data protection in these countries or jurisdictions may differ from the laws in the UAE. We will comply with the laws applicable in the UAE and take all steps reasonably necessary to ensure that similar and/or comparable standards for data protection are maintained by any of our business partners which are recipients of your information. By your voluntary submission of information to us, you are consenting to the disclosure, transfer and use of your personal information outside of the UAE for the purposes described in this privacy policy.

3. Marketing

We do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent. We may combine your information with information we collect from other companies and use it to improve and personalize our services, content and advertising. If you do not want to receive marketing communications from us via e-mail or participate in our ad-customization programs, simply communicate your preference to us via e-mail or log onto your account to change your relevant settings from my account link on the user main page. You may exercise your right to opt out of all communications through the designated opt-out procedure.

4. Security And Data Retention

We implement industry-standard technical and organizational measures, including encryption, access controls, and regular security assessments to protect your information from unauthorized access and against unlawful processing, accidental loss, destruction and damage. We will retain your information only for as long as necessary to fulfil the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements, with a maximum retention period of 7 years from your last interaction with our services, after which it will be securely deleted or irreversibly anonymized.

Where you have chosen a password which allows you to access certain parts of the Application, you are solely responsible for maintaining the confidentiality of your password and account credentials. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with these security obligations.

While we implement industry-standard security measures, the transmission of information via the internet inherently involves certain risks. We cannot guarantee the absolute security of data transmitted to the Application, and you acknowledge that any transmission is at your own risk. You agree to hold us harmless from any breaches, losses, or damages resulting from the transmission of your information, except where such losses arise from our gross negligence or wilful misconduct. Once we receive your information, we employ strict security procedures and features to protect against unauthorized access.

Do not transmit sensitive information (including financial data, health information, government identification numbers, or sensitive personal data as defined by applicable law) unless specifically requested through our secure channels. If you suspect any security compromise or unauthorized access to your account, you must: (1) immediately notify us through the contact methods specified below; (2) change your password; and (3) follow any additional security instructions we provide. While prompt reporting of security concerns helps us protect your account, your fundamental rights under applicable data protection laws will not be affected by any delay in reporting.

5. Cookies

When you visit our Application, we use cookies, web beacons, and similar tracking technologies to identify you as a user and enhance your experience. These technologies help us analyse usage patterns, remember your preferences, deliver personalized content and advertising, and improve our services. While you can control these technologies through your device settings, disabling them may significantly impact the functionality and features available to you. By using our Application, you consent to our use of these tracking technologies as described in this policy.

6. Accessing And Updating

You have the right to: (1) request access to your personal data; (2) request correction of any inaccuracies; (3) request deletion of your data; (4) object to the processing of your personal data; (5) request restriction of processing; (6) data portability; and (7) withdraw any consent you have provided. We will respond to your requests within 30 days or inform you if we require an extension. To exercise these rights, please contact us using the details provided in the 'Contacting Us' section.

7. Changes To Our Privacy Policy

Any changes to our privacy policy will be posted to the Application with a revised "Last Updated" date and, where material changes are made, through e-mail notification at least 30 days prior to implementation. Your continued use of the Application after such modifications constitutes your acknowledgment and acceptance of the modified Privacy Policy.
